ROSSMAN, Justice. This is an appeal by the defendant from a judgment of the circuit court which found her guilty of the crime of manslaughter, ORS 163.040. The indictment charged that on January 23, 1952, the defendant, by the use of the hands, killed her three-year-old daughter Sherry by asphyxiation. The indictment was appropriate to a charge of murder in the first degree. The defendants plea was not guilty.
